Terms of Use
These terms govern your use of this website. They include a disclaimer of warranties, a limitation of liability, and an agreement to resolve disputes through individual arbitration.

Acceptance of these terms
These Terms of Use (the "Terms") are a binding agreement between you and Liberty Compounding Pharmacy ("Liberty," "we," "us"). They govern your access to and use of this website and any content, forms or features on it (the "Site").
By accessing or using the Site you accept these Terms and our Privacy Policy. If you do not agree, do not use the Site. If you use the Site on behalf of a clinic, practice or other organization, you represent that you are authorized to bind that organization, and "you" includes it.
You must be at least 18 years old to submit any information through the Site.
The Site is information only — not medical advice
Content on the Site is general information about compounding services. It is not medical, pharmaceutical or professional advice, not a recommendation of any therapy, and not a substitute for consultation with a licensed prescriber or pharmacist who knows your history.
Nothing on the Site creates a pharmacist-patient or provider-patient relationship. Never delay or disregard professional medical advice because of something you read here. If you think you may have a medical emergency, call 911 or your local emergency number immediately.
Compounded preparations are not reviewed or approved by the U.S. Food and Drug Administration for safety or efficacy. Compounded medications are dispensed only against a valid prescription from a licensed prescriber, and we make no representation that any preparation is appropriate for you.
Do not send sensitive or health information through the Site
The Site's contact form is a general inquiry channel. It is not a secure or encrypted transmission method, and it is not intended for protected health information, prescriptions, diagnoses, medication lists, insurance identifiers, Social Security numbers or payment card data.
Please do not submit that information through the Site. Call the pharmacy at (888) 448-0549 instead. Any information you choose to submit through the Site is sent at your own risk, and to the fullest extent permitted by law we are not liable for interception, loss or disclosure of information you send through an unsecured channel against this instruction.
Permitted use and restrictions
We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for your own personal or internal professional use. All other use is prohibited.
You agree not to:
- copy, reproduce, republish, frame, mirror, sell or create derivative works from the Site or its content;
- scrape, crawl, harvest or use any bot, spider or automated means to access or extract data from the Site, or use Site content to train any machine-learning or artificial intelligence model;
- probe, scan, disable, circumvent or interfere with the Site, its security features, or any network or server it relies on, or introduce malware or any harmful code;
- submit false, misleading or impersonating information, or use the Site to transmit unsolicited commercial messages;
- use the Site in violation of any applicable federal, state or local law, including laws governing pharmacy practice, drug distribution and advertising;
- reverse engineer, decompile or attempt to derive the source code of any part of the Site.
We may investigate and take any lawful action for suspected violations, including restricting access, removing content and referring matters to law enforcement.
Intellectual property
The Site and all of its content — text, layout, graphics, photographs, logos, the Liberty torch mark, the name Liberty Compounding Pharmacy, compiled formulation descriptions, and the design and arrangement of the whole — are owned by us or our licensors and are protected by copyright, trademark and other laws. All rights not expressly granted are reserved.
You may not use our names, marks or trade dress without our prior written permission. Third-party names appearing on the Site are the property of their respective owners and their appearance does not imply endorsement or affiliation.
Your submissions
Apart from information protected under our HIPAA Notice or Privacy Policy, any comment, suggestion, idea or other material you send us is non-confidential and non-proprietary. You grant us a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable license to use, reproduce, modify and display that material for any lawful business purpose without attribution or compensation.
You represent that you own or control the rights to anything you submit and that it does not infringe any third party's rights or violate any law.
Third-party links and services
The Site may link to third-party websites or rely on third-party services. We do not control and are not responsible for their content, accuracy, practices, availability or privacy handling. Links are provided for convenience only and are not an endorsement. Your dealings with any third party are solely between you and that party.
Availability and changes to the Site
We may modify, suspend, limit or discontinue the Site or any part of it at any time, with or without notice, and we may correct, add to or remove content at our discretion. We do not guarantee that the Site will be available without interruption or error, or that content is current. Pricing, availability, turnaround and formulation information is subject to change and to confirmation by the pharmacy.
Disclaimer of warranties
To the fullest extent permitted by law, the Site and all content are provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, that it is free of viruses or other harmful components, or that any content is accurate, complete, reliable or current. No advice or information obtained from the Site creates any warranty not expressly stated here.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.
Limitation of liability
To the fullest extent permitted by law, neither Liberty nor its owners, officers, employees, pharmacists, agents or suppliers will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill, arising out of or relating to your access to or use of — or inability to use — the Site, however caused and on any theory of liability, even if we have been advised of the possibility of those damages.
Our total aggregate liability for all claims relating to the Site will not exceed one hundred U.S. dollars ($100.00).
These limitations apply to Site-related claims. They do not purport to limit any liability arising from the professional pharmacy services we provide, from personal injury caused by our negligence or willful misconduct, or any other liability that applicable law does not permit to be limited or excluded.
Indemnification
You agree to defend, indemnify and hold harmless Liberty and its owners, officers, employees and agents from and against any claims, demands, actions, liabilities, damages, losses and expenses — including reasonable attorneys' fees — arising out of or relating to your use of the Site, your breach of these Terms, your violation of any law or third-party right, or any information you submit through the Site. We reserve the right to assume the exclusive defense of any matter subject to indemnification, at your expense, and you agree to cooperate with that defense.
Binding arbitration and class action waiver
Please read this section carefully — it affects your legal rights.
Any dispute, claim or controversy arising out of or relating to the Site or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small claims court and either party may seek injunctive relief in court to protect intellectual property. Arbitration will take place in Miami-Dade County, Florida, or by videoconference at your election, before a single arbitrator.
You and Liberty each waive the right to a trial by jury and the right to participate in a class, collective, consolidated or representative action. The arbitrator may not consolidate claims or preside over any form of representative proceeding, and may award relief only in favor of the individual party seeking it and only to the extent necessary to resolve that party's individual claim. If this waiver is found unenforceable as to a particular claim, that claim will proceed in court and the rest of this section will remain in effect.
Thirty-day opt-out. You may reject this arbitration agreement by sending written notice of your decision, including your name and address, to the Privacy Officer at Liberty Compounding Pharmacy, 1000 Park Centre Blvd, #136, Miami, FL 33169 within thirty days of first accepting these Terms. Opting out does not affect any other part of these Terms.
Any claim must be brought within one year after it arises, or it is permanently barred, to the extent applicable law permits that period to be shortened. This section does not apply to any dispute the law requires to be resolved in another forum.
Governing law and venue
These Terms and any dispute relating to them or the Site are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-laws rules. For any matter not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida, and waive any objection to that venue. The Site is controlled and operated from the United States and is directed to users in the United States; we make no representation that it is appropriate or available elsewhere.
Changes to these Terms
We may revise these Terms at any time by posting an updated version with a new effective date. Changes apply prospectively from the date they are posted. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms, so please review this page periodically. The current version is effective August 5, 2026.
General terms
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it.
You may not assign these Terms without our written consent; we may assign them freely, including in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and any notices posted on the Site, are the entire agreement between you and us regarding the Site. Sections addressing intellectual property, submissions, disclaimers, limitation of liability, indemnification and arbitration survive termination of your use of the Site.
